How Fairvia respects firm independence and attorney judgment

No. Fairvia is an administrative technology tool. It captures and organizes facts and applies your firm-written intake rules. It does not give legal advice, does not predict case outcomes, and does not make representation decisions. Those remain exclusively with your attorneys under the California Rules of Professional Conduct including Rules 5.3, 5.4, and 8.4.

Rule 5.3 requires reasonable efforts to ensure that nonlawyer services are compatible with your professional obligations. Fairvia is designed to support that duty by keeping your attorneys in charge of criteria, providing an auditable record of how screening was applied, and allowing your team to override the FirmFit Index at any time. Your firm still must supervise and approve how the tool is used.

Fairvia charges a flat service fee per attorney ready appointment for technology and administrative work. It does not receive a percentage of legal fees, does not negotiate fees with clients, and does not promise outcomes. Your firm stays in control of all fee agreements. As always, your own ethics counsel should review the arrangement under Rules 5.4 and the related advertising and solicitation rules before adoption.

Prospect and client data are stored in an isolated secure sub-account for your firm. Access is limited to your authorized users and essential system operations. Data in transit and at rest is encrypted, and you can request exports or deletion according to your retention policy. Fairvia does not sell or reuse your client data for unrelated purposes.

The FirmFit Index only uses objective administrative facts such as timing, employer size and issue keywords that you specify. Fairvia is configured to avoid use of protected class data, and your firm can review every inquiry, including those that do not receive a high FirmFit score. This allows your attorneys to correct any pattern that feels inconsistent with your obligations under Rule 8.4 and your own internal equity standards.

Yes. Each inquiry carries an auditable record that shows the original intake data, extracted facts, FirmFit Index values and any changes made by your staff. This record is available for internal review and can support your supervision obligations under Rule 5.3.
